Terms of Use for the Service Portal

This Service Portal is made available for your use subject to the following terms and conditions (the "Terms of Use"): 

  1. You may login to the Service Portal using the date of birth you provided at the time of ordering and the payment reference provided to you on the payment information (together, the "Access Data").
  2. You are obliged to read these Terms of Use before logging in with your access data or using the Service Portal. By entering the access data and clicking on the button confirming the entry of the access data, you agree to the Terms of Use in the currently valid version. 
    The Service Portal allows you to retrieve information on the payment status and other information about your purchase in the respective online shop.

  4. The Service Portal is provided to you by Payla Services GmbH - https://payla.de/en/ (hereinafter also "Payla", "we", "us"). The provision of the Service Portal for the processing of your order is carried out by us in cooperation with the respective online merchant you ordered from and its cooperation partner. 
  5. No contractual relationship is established between you and us through the provision or use of the Service Portal. 
  6. You are not entitled to pass on your access data to third parties. All entries made using your access data will be traced back to you. 
  7. You are also obliged to inform us immediately if you suspect that the access data has become known to unauthorised persons or if you become aware of any illegal, abusive or otherwise unauthorised use of the Service Portal. Please use the following contact option: info@payla-mail.com. We will then examine the matter and, if necessary, take appropriate steps. 
  8. You are prohibited from any activities on or in connection with the Service Portal that violate applicable law, infringe the rights of third parties or violate the principles of the protection of minors. Also prohibited is any action that is likely to impair the smooth operation of the Service Portal, in particular to place an excessive load on our systems. In case of suspicion of illegal or punishable actions, we are entitled and, if necessary, obliged to check the activities in question and, if necessary, to take appropriate legal steps. This may also include forwarding the facts of the case to the competent state investigation authorities.
  9. The contents available on the Service Portal are protected by copyright or by other property rights and are in each case our property or the property of the respective online merchant and/or its cooperation partner, which have made the respective contents available to us. The compilation of the contents within the framework of the Service Portal as such is possibly protected as a database or database work within the meaning of §§ 4 Para. 2, 87 a Para. 1 UrhG (German Copyright Act). The use permitted to you of these contents results from the framework given in the Service Portal. You are prohibited from processing, modifying, translating, presenting or performing, publishing, exhibiting, reproducing or distributing this content in whole or in part.
  10. Insofar as claims are asserted against us by third parties as a result of an infringing act by you (within the meaning of the above paragraphs), you undertake to indemnify us in full against such claims.
  11. We will use our best efforts to provide you with the Service Portal without any major downtime and will correct any defects in the Service Portal as quickly as possible. However, you have no right to constant availability of the Service Portal.
  12. We may temporarily block your access to the Service Portal in whole or in part, in particular due to maintenance work, capacity requirements and other events beyond our control. However, we will ensure that any such interruption to the availability of the Service Portal is kept as short as possible. You will also find all the necessary payment details for your order on the respective payment information that you have already received by e-mail and/or post.
  13. We are also entitled to discontinue the Service Portal at any time and with immediate effect at our own discretion and without giving reasons.
  14. You agree that we may monitor your use of the Service Portal, in particular to ensure its quality and security, to improve it and to check that you are complying with these Terms.
  15. Claims for damages by you against us are excluded, unless otherwise stipulated below. The above exclusion of liability shall also apply in favour of our legal representatives and vicarious agents, if any, insofar as you assert claims against them. Excluded from the exclusion of liability specified in sentence 1 of this clause are claims for damages due to injury to life, limb and health. Also excluded from the exclusion of liability is liability for damages based on intentional or grossly negligent breaches of duty by us, any of our legal representatives or vicarious agents.
  16. We reserve the right to change these terms of use at any time, in particular to take account of changes in the law or changes in the scope of functions of the Service Portal. 
  17. If any part of these Terms of Use is found to be invalid, illegal or unenforceable, only that part shall be ineffective and the remaining terms shall not be affected or impaired thereby. 
  18. The personal data processed by us in the context of the provision and use of the Service Portal is carried out in accordance with the applicable data protection provisions, in particular Regulation (EU) 2016/679 (EU General Data Protection Regulation, DSGVO). You were informed about the processing of your personal data prior to your order by the supplementary data protection information (https://legal.pay.tpgpay.de/en/data-protection-payments.html), which also apply to the data processing in the context of the provision and use of the Service Portal. 
  19. These terms and conditions are subject to German law. The exclusive place of jurisdiction for all disputes arising from these terms of use is Munich in Germany, insofar as such a jurisdiction agreement is permissible.
